It is initially for 6 months but can be renewed. You have the same rights of appeal as when you were detained. You can be recalled to the hospital if your Responsible Clinician thinks it necessary. What sort of conditions? Depending on your circumstances, your CTO could be revoked, which means you'll have to stay in hospital, or you could be allowed to leave hospital and continue your CTO. The length of time you could be detained for depends on the type of mental health condition you have and your personal circumstances at the time.Section 5(2) gives doctors the ability to detain someone in hospital for up to 72 hours, during which time you should receive an assessment that decides if further detention under the Mental Health Act is necessary. When can someone be sectioned? This is because it's felt you do not have sufficient capacity to make an informed decision about your treatment at the time. Once there, you will have your rights explained to you and will be given a copy to keep. You will be placed under the care of a responsible clinician (usually a psychiatrist). Most people are also offered the assistance of an Independent Mental Health Advocate, who can help you understand your rights, listen to your concerns and speak on your behalf.The responsible clinician in charge of your care can place conditions on the leave, such as where you should stay while away from the hospital and whether this will be for a fixed period of time. To be legally sectioned, at least two of these medical practitioners must write a statement explaining how they feel you comply with the criteria above and a recommendation for you to be sectioned. This rule is slightly different if it’s an emergency that you be detained, in which case a doctor, police officer or magistrate can detain you, depending on where you are when the emergency arises. Where do you go? Once you have registered, you can also ask your local council for a postal vote, or you may be able to get permission to leave the hospital to vote, either accompanied by hospital staff or on your own. You do not need to have committed a criminal offence to be sectioned. The Mental Health Act is designed to be used for both the general public and for those in the criminal justice system. The Mental Health Act often uses this term. It also tells you who your nearest relative should be. The term is used to refer to someone who looks out for you and makes sure your wishes and choices are heard and understood.
